Man in Queens receiving private patient information from CVS
Recently I posted about a article that stated that patients can’t really sue about a HIPAA violation https://www.pharmaciststeve.com/?p=5844
From the article:
An Eyewitness News exclusive as private patient information, intended for a doctor, mistakenly faxed by a nationwide pharmacy chain to a man in Queens.
Be interesting if the FEDS follow up with this MAJOR HIPAA VIOLATION and sue CVS .. or just let CVS “off the hook” as some sort of wayward technical error as the excuse for the violation… promising to RETRAIN or fire some employee(s) ?

Please show me where the HIPAA regulations allow you to put out a blanket statement that if you screw up that automatically absolved you from violating the law. IMO.. If that worked, then we should be putting a similar statement at the bottom of all labels and receipts. I can hear it now, when you answer the phone… ” .. Welcome to big chain pharmacy .. We only employ humans and if we make an mistake we are now giving you notice that we can’t be held responsible for any errors or misinformation that we give you…”
Steve sometimes I wonder if you ever really practiced pharmacy. Did you never accidentally send a fax to a wrong number? Have you never noticed the disclaimer on faxes received at the pharmacy “if you have received this fax in error please notify the sender and destroy…” etc.
