Another sign of the impact of the RPH surplus ?

one of the questions is:

1. I have been diagnosed or treated for any mental illness, or alcohol or substance abuse issue, or other physical condition/s that would impair my ability to perform any of the essential functions of my profession. No Yes

It is estimated that 20% of the population will take a anti-depressant at any given point in time. Does this mean that any RPH taking any anti-depressant is considered less than competent?

What is next, if you are a epileptic … you are no long considered competent? If you have ADD/ADHD.. is that a mental illness ?

Now that there is a surplus, is there is little incentive of the BOP’s to protect the RPH’s within the  labor pool?

These BOP’s will not “interfere with a permit holders business operation”… by mandating meal/rest breaks.. so it appears that lack of sleep and fatigue does not impair competency .. since they won’t address these issues…

Will the BOP’s start asking for physician and medication medical records? Will centralized electronic records… allow BOP’s easy access to these records?

Could this type of questioning, allow the permit holder and the insurance company to deny any coverage of a paying for a med error… because you were “impaired” and didn’t recuse yourself from working and/or lied about it on the renewal application.

Of course, if a RPH could prove that the typical stressful work environment was the reason for being treated with mental health drugs.. could this be a valid reason for a workman’s comp and disability claim ?

How many other states have put such a question on their RPH renewal application?
