After reading things like this… I know why I could never be any attorney.. this kind of stuff makes my eyes roll back into head..
*A few points of interest… CVS claims that they are not a “public body”
*They claim that the PIC is NOT RESPONSIBLE for errors happening in the Rx dept when the PIC is not there ..
* That the PIC or Pharmacist had no legal responsibility to report robot filling errors to the BOP..
There is also evidence – not posted here – that strongly suggests that the BOP BACK-DATED who was PIC of this particular Rx dept on the store’s permit… and CVS claiming in this pleading… that it was done before a certain date. Even though after that date… there is documentation of the store’s permit – posted in the store – with Joe still listed as PIC.
I have said before.. if you work for one of these corporate bullies .. document.. document.. document.. if you did not document what you know/saw.. then it didn’t happen..

As much as I would like to CVS lose this case, I am not holding my breath. They will drag this out until we are all in our graves. I am rooting for Joe, though.
And remember, anyone can sue anyone in this country. However, the one with the deepest pockets usually wins…
You are correct…but when a entity being sued is breaking Federal and State Laws.. the deepest pockets.. usually loses their advantage
