Karen Scavetta worked as a pharmacist for King Soopers, Inc. She had worked at King Soopers for thirty years, and in the position of a pharmacist since 1994. Scavetta suffers from rheumatoid arthritis. That condition “causes pain, swelling and damage to the joints, impeding the movement and function of joints.” This condition made her unable to administer flu shots.

King Soopers filed for summary judgment, responding that her claim under the ADA should fail because flu injection services was an essential part of her job description and she could not perform this function.

The court noted “at least ten other similarly-situated pharmacists who had medical restrictions were exempted from giving immunizations.”

Besides the dexterity problems with her hands… her RA messes with her immune system and should not be exposed to some of these vaccines..

Another Senior RPH… getting ILLEGALLY  kicked  to the curb. More and more are learning to KICK BACK !

  1. Don’t companies understand that there are going to be some exceptions to the RULE! Of course, there are going to be a few pharmacists that physically cannot do part of their job. Every business has these employees. I am glad the pharmacist won, but there was no reason for it to go to court in the first place.

  2. Yippeee! Great that the pharmacist won! That company can take there BS and shove it!

  3. Whatever happened to reasonable accomodation?

    Isn’t reasonable accommodation when a business fails to follow the rules and an employee ends up suing the employer.. otherwise.. it is just a “suggestion”?
