When “Zero Tolerance” may not be absolute !

A former pharmacist at a Walmart in California said she was fired by the retail giant because of her Christian beliefs. Now she is suing for religious discrimination, saying the store claimed to have caught her praying with a customer on camera, and cited that as the reason for termination.

Her termination letter does not mention praying and instead cites “misconduct,” which Doan believes was in reference to allegedly praying with patients,

Her attorney believes Doan was labeled as a “troublemaker” after she sent an email to her managers noting “several compliance issues with other employees,” such as bringing drinks into the pharmacy, pharmacists not following DEA requirements for controlled substances, using cell phones in the pharmacy and other prohibited actions.

Randy Hargrove, a spokesman for Walmart, said the company “has a zero tolerance policy with respect to harassment or discrimination, including religious discrimination.”

She was just shy of her six-year anniversary and had earned over $170,000 plus benefits last year

This would suggest that this Pharmacist worked much more than the standard 40 hr week for the company and had been at this Walmart store since 2006.

Don’t know how long it will take for this to play out in the courts.. that is.. unless Walmart throws wads of money at this Pharmacist with a confidentially agreement. Which it will never be heard from again…

Unless it is just me, I am noticing many more Pharmacist dismissals getting to a higher visibility with the media… now if we can get that same visibility for medication errors

  1. This is something surprising to me! Wal-Mart promotes the company as being family and community oriented. I cannot imagine them firing this pharmacist for the ‘prayer’ reason. And, what is wrong with touching a customer? When did touching become inappropriate? Sounds like she has a good legal case. In her case, it seems the DM fired her. More than likely the DM conferred with Regional and the Regional probably made the decision and the DM did the actual firing. There are some things she could do to try and get ‘reinstated’. No need to contact her DM or Regional. She will need to contact HR at the home office.
