Working while being opiophobic ?

This was a comment on a website … that I ran across…  I suspect that any pt that has had knee , hip replacement or has a bunch of metal in their spine or one or more spinal joints fused… The chances of them being able to walk a straight line.. is somewhere between slim and NONE ! Medications not withstanding… probably even less if they have been on a “pharmacy crawl” and out of their medications or overly anxious about not getting their meds… all could affect their composure and ability to walk a straight line. I wonder if the pt had been a diabetic and was dealing with a low blood sugar episode… and was stopped by a cop… under similar circumstances… what would the person be charged with – if anything… Amazing how a subjective observation can turn into a factual charge/arrest.

  1. This is a money maker. In Tennessee the police can access the great monthly monitoring narcotics sheet so they can charge you. I have wondered if it was 12 hours past the Percocet ordered every 6 hours if I could be charged impaired? In Kentucky 15 years ago my son was stopped and charged with dui at 19. Paid attorney $1000 and his bond. Robert told me he passed the tests. The attorney called and said if Robert paid -me lol-another$ 1000 that case dismissed. Robert went to court to find everything was lost for his case including the film of the stop. He did go to a 2 hour traffic school. Glad it was off his record but still feel like he was set up. But do we ask for blood test or take a chance?

    • Starwood500 Thanks fot that info…I’lI have to remember that if we ever drive south (I’ll have to make sure I’m driving) I’ll have to check that out. I suppose TN has cross state access, but I bet I could challenge that because IN law says law enforcement says they must have a warrant for access to our monitoring program and that should include other states LE. (That might be a IBOP question or my attorney)

  2. I get concerned about my spouse who is on controlled substances for another diagnosis and is also diabetic. He has been pulled over twice very early in the AM going to work because the cops felt he crossed the center line, but was let off with a warning both times.At the time he goes to work, the bars here haven’t been closed very long. He tells them he is on his way to work and he’s always stopped a block or 2 from his job. Some nights he has trouble sleeping, so he’s tired on the way into work and the caffiene hasn’t hit yet. I spoke with our attorney about it. In our state, you can be charged with OWI if you test positive for controlled substances or metabolites, he said if you have a legal prescription and the levels are within therapeutic range, the charges could be dropped. Its the ones that dont have the prescriptions are who they want. Of course I told him if this happens, he’ll be getting a phone call.
