The heart of the Rite Aid case was whether a violation of the Fair Labor Standards Act (FLSA) occurred with regard to roles, duties and responsibilities of exempt and non-exempt employees.
Exempt employees who wear many hats at work, like Rite Aid’s assistant store managers, should be compensated as non-exempt employees whenever they spend a significant portion of their workday performing duties such as operating the checkout registers, stocking shelves, bagging groceries and cleaning.
The question has to be asked…. what is significant portion of an employee workday? If you are a RPH and you are working alone in the Rx dept… running the register and other clerical duties.. are you still an exempt employee?

The pharmacy managers at Wal-Mart are being forced to paint a wall. Does this come under ‘non-exempt’? I think the Wal-Mart pharmacy managers have a good case for a class action suit.
